Terms of Service
Effective October 18, 2026
At a glance
- These terms apply whenever you use surveyhood.com, whether you build surveys, buy responses, or answer a survey.
- Your surveys and the responses you collect belong to you. We use them only to run the service for you.
- Paid plans renew automatically until you cancel. Cancelling stops the next renewal and you keep access until the period ends.
- When you buy responses you pay only for completes that pass our quality review.
- Participants who join our panel to earn rewards also accept the Participant Terms.
This summary is for convenience. The full text below is what applies.
1. Who we are and what these terms cover
SurveyHood (“SurveyHood”, “we”, “us”) runs the online survey service at surveyhood.com from McKinney, Texas. These Terms of Service (“Terms”) form a binding agreement between us and anyone who uses the service (“you”).
If you use SurveyHood for an organisation, you confirm you are authorised to accept these Terms for it, and “you” includes that organisation.
Some parts of the service come with extra terms, which form part of this agreement where they apply:
- Participant Terms for people who join our panel to take surveys for rewards
- Acceptable Use Policy and Email Invitation Policy for everyone who creates surveys
- Data Processing Addendum for customers who collect personal data through SurveyHood
- Billing, Cancellation and Refund Policy for paid plans and response orders
- Any signed order form or enterprise agreement, which wins over these Terms if the two conflict
2. Accounts
You must be at least 18 years old to create an account. Give accurate information, keep your sign-in details private, and tell us promptly at support@surveyhood.com if you think someone has accessed your account without permission.
You are responsible for what happens under your account, including the actions of team members you invite. Owners and admins of a workspace control who has access to it and to its surveys.
3. Using the service
Subject to these Terms and your plan, we give you a non-exclusive, non-transferable right to use SurveyHood to create surveys and forms, collect responses, buy responses from respondents, and analyse and export results.
We keep improving the product, so features may change. If we remove a core feature of a paid plan you are using, we will tell you in advance where practical, and you may cancel.
Plan limits (surveys, responses per month, seats and AI usage) are shown on the pricing page. If you go over your monthly response allowance, we accept up to 10% more; responses beyond that are held until you upgrade or the next month begins. The Pro plan’s higher allowance is subject to fair use.
4. Your content and your responses
“Your content” means the surveys, forms, questions, images, branding and settings you create, and the responses you collect or buy. You keep all rights in your content.
You give us permission to host, copy, process, transmit and display your content only as needed to run, secure and support the service for you, including sending it to the service providers listed on our Subprocessors page. We do not sell your content or use your responses to advertise to anyone.
You are responsible for your content and for having a lawful basis to collect any personal data you ask for. Where you collect personal data through SurveyHood, our Data Processing Addendum applies and we act as your processor.
You can export your results (CSV, Excel and PowerPoint) and download your account data at any time.
5. Buying responses
You can order completed responses from people in supported countries. Responses come from the SurveyHood participant panel or, where you allow it, from licensed partner panels. Each response shows its source.
- Quotes. A quote shows the price per approved complete, the total, and the expected fielding time. Quotes are valid for 72 hours.
- Payment. You pay the quoted total when you place the order.
- Quality review. Every purchased complete goes through automated checks and a human review. You pay only for completes we approve. Screen-outs and rejected responses are never charged.
- Unused budget. When an order closes, any amount for completes not delivered is refunded to your original payment method.
- No guarantee of feasibility. We tell you if an audience is unlikely to fill, but we cannot guarantee that every order will reach its target in the estimated time.
Buyers never receive participants’ names, email addresses or other contact details through a response order. Do not ask participants to identify themselves or to contact you outside SurveyHood.
6. Plans, fees and taxes
Paid plans are billed in advance, monthly or annually, through our payment processor, Stripe. Plans renew automatically at the end of each period until you cancel. Annual plans are discounted as shown at checkout.
Prices may change. We will give at least 30 days’ notice of a price increase on your plan, and it will apply from your next renewal after the notice period. Upgrades take effect immediately with a prorated charge; downgrades take effect at the end of the current period.
Prices exclude taxes unless stated. Applicable sales tax is calculated at checkout.
Cancellation and refund rules are in our Billing, Cancellation and Refund Policy.
7. Acceptable use
You must follow our Acceptable Use Policy and Email Invitation Policy. In short: no unlawful, deceptive or harmful surveys; no harvesting of personal data under false pretences; no spam; and no attempts to break, overload or reverse-engineer the service.
8. AI features
Some features use AI to draft surveys, review questions, translate, summarise results and group open-text answers. AI output can be wrong or incomplete; check it before you rely on it or publish it. How AI features handle data is explained in our AI Features Notice.
9. API and integrations
If your plan includes API access, keep your API keys secret and rotate them if exposed. We apply rate limits to protect the service. Webhooks you configure must point to endpoints you control; we sign every webhook so you can verify it came from us.
Third-party services you connect are governed by their own terms, and we are not responsible for them.
10. Our intellectual property
SurveyHood, our logo, the software, templates, guides and site content belong to us or our licensors. You may use our templates to build your own surveys. You may not copy, resell or redistribute the service or its templates as a competing product.
If you send us feedback or ideas, we may use them without any obligation to you.
11. Suspension and termination
You can stop using SurveyHood at any time and delete your account from your account settings. Deletion has a 30-day cooling-off period during which you can change your mind.
We may suspend or close an account, or remove content, if we reasonably believe it breaks these Terms or the law, puts other users or participants at risk, or exposes us to liability. Where appropriate we will tell you why and give you a chance to fix the problem first. If we close a paid account without cause, we will refund prepaid fees for the unused period.
Sections that by their nature should continue after the agreement ends (including payment obligations, intellectual property, disclaimers, liability limits and disputes) survive termination.
12. Disclaimers
We work hard to keep SurveyHood available, secure and accurate, but the service is provided “as is” and “as available”. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the service will be uninterrupted or error-free, or that survey results will support any particular conclusion.
Statistics, benchmarks and guidance on our site are for general information. They are not professional, legal or financial advice.
13. Limitation of liability
To the extent the law allows, neither party is liable to the other for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, even if told they were possible.
To the extent the law allows, our total liability for all claims relating to the service in any 12-month period is limited to the greater of (a) the amount you paid us in that period and (b) US$100.
These limits do not apply to liability that cannot be limited by law, such as liability for fraud.
14. Indemnity
If you use SurveyHood for business, you will defend and indemnify us against third-party claims arising from your content, your surveys, or your breach of these Terms or the law, and you will pay any resulting damages and reasonable legal costs.
15. Governing law and disputes
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law rules. The state and federal courts in Collin County, Texas have exclusive jurisdiction, and both parties consent to it, except that either party may seek urgent injunctive relief in any competent court.
Before starting formal proceedings, please contact support@surveyhood.com so we can try to resolve the issue informally within 30 days.
If you are a consumer, nothing in these Terms removes rights you have under the mandatory laws of the place where you live.
16. Changes to these Terms
We may update these Terms as the service and the law change. We will post the new version here with a new effective date and, for material changes, tell account holders by email or in the app at least 14 days before they take effect. If you keep using SurveyHood after that, you accept the updated Terms.
17. General
These Terms, together with the policies they refer to, are the whole agreement between us about the service. If a provision is unenforceable, the rest still applies. Failing to enforce a right is not a waiver of it. You may not transfer this agreement without our consent; we may transfer it as part of a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control.
